UPDATE: Driver Charged in August 12 Kirby Road Fatal Pedestrian Crash

McLean Police District – Gamaathige Desoya, 80, of Vienna, was served on summons releasable charges related to a fatal pedestrian crash on August 12 on Kirby Rd in the McLean District.

Detectives from our Crash Reconstruction Unit determined Desoya was attempting to make a left turn onto northbound Kirby Road but turned into the southbound lanes striking Brigitte Forster while she was in the crosswalk. Today detectives served summons releasable citations for Improper Turn and Failure to Yield for a Pedestrian in a Crosswalk. Excessive speed and alcohol are not believed to be factors in the crash.

McLean Police District – An 86-year-old woman was pronounced deceased following a fatal pedestrian crash in the 1700 block of Kirby Road in McLean.

Preliminarily, detectives from our Crash Reconstruction Unit determined Brigitte Forster, of McLean, was within the crosswalk attempting to cross Kirby Road around 6 a.m. yesterday morning. The driver of a 2009 Toyota Sienna was turning left onto northbound Kirby Road from the parking lot of 1728 Kirby Road. The driver cut the turn short and entered the southbound lanes striking Forster in the crosswalk. Forster was taken to a nearby hospital where she was pronounced deceased. The driver remained at the scene of the crash.

Preliminarily, detectives do not believe speed or alcohol are factors in the crash. Detectives continue to investigate the circumstances surrounding the crash.

This is the 6th pedestrian-related fatal crash in the County to date in 2023. Year-to-date, in 2022, there were 12 pedestrian-related fatal crashes.
